Recommended Open Internet Transparency Rule Disclosures
INTRODUCTORY NOTE TO RESELLER: Broadband wireless services are regulated by the Federal Communications Commission (“FCC”). A part of that regulation applicable to resellers, like you, is a regulation requiring that you disclose certain practices to your customers. While we are not taking any responsibility for your regulatory compliance, as a courtesy, we recommend that you make effective disclosures to your customers of certain practices in accordance with the FCC’s Transparency Rule, set forth at 47 CFR 8.1, 8.2 and 8.3. These are your regulatory responsibilities rather than Mission Telecom’s because you have the direct relationship with the end-users.
The Transparency Rule requires broadband service providers to “publicly disclose accurate information regarding the network management practices, performance, and commercial terms” of their broadband Internet access service. The purpose of the FCC’s Transparency Rule as applied to broadband providers like you is to provide consumers with information on your services “sufficient for consumers to make informed choices regarding the use of such services….” To that end, we recommend that you provide the following written disclosures to customers and such further disclosures as you may determine to be necessary or advisable in accordance with the FCC’s Transparency Rule.
In making disclosures, the FCC has stated that it expects “advertisements and other public statements that broadband Internet access providers make about their services [to be] accurate and consistent with any official disclosures that providers post on their websites or make available in stores or over the phone.” Thus, “a provider making an inaccurate assertion about its service performance in an advertisement, where the description is most likely to be seen by consumers, could not defend itself against a Transparency Rule violation by pointing to an ‘accurate’ official disclosure in some other public place.” We regard this as common sense, but we still want to point it out to you.
The disclosures below address primarily how T-Mobile currently offers the Service and actions it may take with respect to the Service that may affect your Permitted Users. Mission Telecom LLC cannot represent that these disclosures will provide a complete or entirely accurate summary of these T-Mobile practices, as we are dependent for this information upon what T-Mobile tells us and what information T-Mobile publishes on its website, which website information may not apply to the Service. To reiterate, this recommendation is provided as a courtesy only, and without any warranty expressed or implied that the disclosures are sufficient, complete or entirely accurate.
The FCC requires that you provide these or similar disclosures at the point of sale and they also should appear on your website. The practice of commercial broadband providers is to separately state these policies in an “Open Internet Information” webpage or contract attachment.
The FCC, as you would expect, requires you to maintain the continuing accuracy of these disclosures. In the event that you become aware of a change in any statement made in these disclosures, you must inform users of these changes. The FCC expects such information on changes to be disseminated within a reasonable period of time following the changes but has not defined an outer time limit for such dissemination.
The FCC requires two separate disclosures. One is the Open Internet Disclosures described below and the other is a Broadband Label, which is much like the nutrition label found on food packaging. The content of the label must be displayed on Reseller's website in a machine-readable format. The Reseller must also provide the information in any label separately in a spreadsheet file format on its website via a dedicated uniform resource locator (URL) that contains all of their labels. The label must be provided in English and in any other languages in which the Reseller markets its services in the United States. Mission Telecom’s website contains sample broadband labels which you are invited to use to model your own labels. Those sample labels are available at www.missiontelecom.org/legal. To reiterate, these samples are made available as a courtesy only, and without any warranty expressed or implied that the disclosures are sufficient, complete or entirely accurate. These samples may be changed with or without notice and may become obsolete due to changes in the Service provided by the Provider.

• Service Description:
1. We are providing you (“you” or “Customer”) an Internet access service (“Service”). We are not providing you any applications (such as Internet telephone or cable TV) that might be provided with such service by other vendors. We are not involved in the creation or the provisioning of the Service. Instead, we resell a service provided to us indirectly by T-Mobile.
2. T-Mobile’s service is provided over its wireless network, using cell sites, other transmitters and frequencies licensed by the FCC. The Service is not available in all locations, and you will be able to access the Service only when within the operating range of T-Mobile’s network, which may change from time in the sole discretion of T-Mobile. The Service may be unavailable from time to time due to maintenance of the Service, emergencies, network congestion or other factors outside of our control, and your access to the Service may be interrupted or refused, and performance of the Service may be limited or curtailed from time to time. The Service and the modem or other hardware required to use the Service (“Equipment”) may not function in the event of a power failure or disruption, and the user may be required to reset or reconfigure the user’s Equipment in order to use the Service thereafter.
3. Your use of the Service is subject to all applicable laws and regulations and you must comply with all applicable laws and regulations in the use of the Service.
4. Your use of the Service is subject to the terms referenced in the applicable Mission Telecom Terms & Conditions (as they may be changed, the “MT- Ts&Cs”) and Customer must comply with the MT-Ts&Cs, as well as all applicable laws and regulations, at all times in its use of the Service, and Customer will be responsible and liable for Customer’s non-compliance with the MT- Ts&Cs or applicable laws and regulations.
5. Customer’s use of the Service is subject to most of the Sprint Terms and Conditions as applicable and as may be modified from time to time (“T-Mobile Ts&Cs”), posted on the T-Mobile website (as of August 1, 2025 located at https://www.t-mobile.com/responsibility/consumer-info/policies/internet-service), and as well as such terms and conditions applicable to the particular service you receive, as explained below. Any particular T-Mobile service may be offered by T-Mobile to its subscribers along with subscriptions to non-connectivity services. Mission Telecom’s offer of the same or substantially the same service excludes these non-connectivity services. The -Mobile Ts&Cs apply to your Service to the extent they are not superseded by your agreement with us, as explained in that agreement.
6. Further information on T-Mobile’s broadband access services, including FCC-required information, can be found at the Sprint Disclosures (see Privacy Policies, below).
7. THE SERVICE MAY BE SUBJECT TO USAGE LIMITS ESTABLISHED BY T-MOBILE, WHICH ARE NOT CONTROLLED BY US. T-MOBILE MAY CHANGE THE USAGE LIMITS FROM TIME TO TIME. WE MAY NOT HAVE ADVANCE NOTICE OF ANY SUCH CHANGES AND, FOR THAT REASON, IT MAY NOT BE REASONABLY POSSIBLE FOR US TO GIVE YOU ADVANCED NOTICE OF ANY SUCH CHANGES. We have provided you with information on the expected data allowance of the Service. We have no way of determining the expected and actual access speed and latency of the Service, or the suitability of the service for real-time applications.
• Pricing: The prices for the broadband service we provide you are set forth [insert location]. The prices do not include applicable taxes and surcharges, which will be added to the prices for service. If your pricing is based upon a promotional rate, you have been informed of the promotional nature of the rate and the duration of the promotional period, as well as the full periodic service charge you will pay after the end of the promotional period. There [are not/ may be] one time or recurring additional fees, including early termination fees as stated here: [ X ]. As explained below, your service may be subject to data caps or allowances imposed by T-Mobile.
• Privacy Policies: We do not own, operate, maintain, or control the Service, and do not have network management practices that entail the inspection of network traffic. As a reseller of service, we do not store personally-identifiable traffic information, we do not provide personally-identifiable traffic information to third parties, or use that information for non-network management purposes. The underlying service provider, Sprint, has network management practices that entail the inspection of network traffic; Sprint stores network traffic data; Sprint can be expected to use network traffic data for purposes in addition to non-network management purposes; and Sprint may provide network traffic data to third parties. T-Mobile discusses these matters generally at its “Open Internet” webpage at https://www.t-mobile.com/responsibility/consumer-info/policies/internet-service and at its “Privacy Center” which is available online at https://www.t-mobile.com/privacy-center/privacy-notices/t-mobile-privacy-notice (as they may be changed, referred to collectively as the “T-Mobile Disclosures”). T-Mobile’s use of network traffic data and its privacy policies are subject to change without notice. In addition, T-Mobile may have taken the position that this Service is not subject to the FCC’s Open Internet Rules and, based upon that position, T-Mobile may treat this Service differently than it treats other broadband Internet access services it offers and in manners or respects that differ from statements made in the Open Internet Information.
• Redress Options: If you have a complaint about our service, please contact [ X ] to resolve the complaint. Your Agreement will govern dispute resolution generally.
• Congestion Management: We do not own, operate, maintain, or control the Service, and do not engage in network congestion management practices. T-Mobile, as the underlying provider of the Service, uses network congestion management practices that may interfere with the speed or the availability of your Service. You should review the T-Mobile Disclosures for the network congestion management practices that may affect your use of the Service, including descriptions of congestion management practices; types of traffic subject to practices; purposes served by practices; practices’ effects on end users’ experience; criteria used in practices, such as indicators of congestion that trigger a practice, and the typical frequency of congestion; usage limits and the consequences of exceeding them; and references to engineering standards, where appropriate.
• Application-Specific Behavior: We do not own, operate, maintain, or control the Service, and do not engage in the blocking or rate-control of specific protocols or protocol ports, nor do we modify any protocol fields or inhibit or favor any applications or classes of applications. Sprint, as the underlying provider of the Service, may engage in one or more of those activities. You should review the Sprint Disclosures for application-specific practices by Sprint that may affect your use of the Service.
• Device Attachment Rules: We do not restrict the devices that you may attach to use the Service, but please be advised that not all devices available for purchase may operate with the Service. Requirements for modem and hardware compatibility with T-Mobile’s network are set forth At www.t-mobile.com. If you do not procure your user equipment from us or T-Mobile, you are responsible for ensuring that it meets the minimum technical requirements posted on T-Mobile's website. If you purchase a modem or other user equipment from an entity other than us, Mission Telecom or T-Mobile, you should follow the process for activation set forth in the Quick Start Guide provided with the device or found on the T-Mobile website.
• Security: We do not own, operate, maintain, or control the Service, and do not take any measures to assure the security of your use of the Service or the security of the network. T-Mobile, as the underlying provider of the Service, may take action to guard your security in the use of the network and to safeguard the network. Please refer to the T-Mobile Disclosures for additional information.
