As a result, while we have some control over the network management practices and performance characteristics applicable to the Broadband Services you receive from us, we do not actively manage all aspects of the network and its performance &#8211; our Underlying Carrier retains control.<\/p>\n<p>Nothing in this disclosure changes your rights and obligations, or ours, under our <a href=\"https:\/\/missiontelecom.org\/es\/legal\/terms-conditions\/\" target=\"_blank\" rel=\"noopener\">T\u00e9rminos y condiciones<\/a>, <a href=\"https:\/\/missiontelecom.org\/es\/legal\/website-terms-of-use\/\" target=\"_blank\" rel=\"noopener\">Website Terms of Use<\/a>, or <a href=\"https:\/\/missiontelecom.org\/es\/privacy-policy\/\" target=\"_blank\" rel=\"noopener\">Pol\u00edtica de privacidad<\/a>. \u00a0This disclosure is provided for informational purposes only and we may change it at any time, without notice. Your broadband access will be provided as described in your particular service plan, which governs in case of any contradictions with this Disclosure.<\/p>\n<p><strong>Important Note on Provider Status:<\/strong>\u00a0Mission Telecom acts as a distributor of the internet service provided by a third-party Provider, currently T-Mobile USA, Inc. We do not own, operate, maintain, or control the physical network. Consequently, we do not control the majority of the network management practices (including data caps, throttling, congestion management, security, and application behavior); these practices are controlled by the Provider (T-Mobile). Customers are advised to review the T-Mobile Open Internet webpage for the most detailed information regarding the Provider&#8217;s practices.<\/p>\n<p><strong>Network Management Practices <\/strong><\/p>\n<p>Mission Telecom&#8217;s network management practices are implemented on a\u00a0<strong>content-agnostic basis<\/strong>\u00a0and do not discriminate against offerings that might compete against Mission Telecom or any affiliate.<\/p>\n<p><strong>How does Mission Telecom manage congestion with respect to its Broadband Services?<\/strong><\/p>\n<p>Mission Telecom strives to provide a high-quality Internet experience for all our customers via the resale of services on our Underlying Carrier&#8217;s network.\u00a0 Mission Telecom does not directly engage in network congestion management practices. However, because bandwidth is a limited resource and the network of our Underlying Carrier is shared among Mission Telecom&#8217;s customers and other users of our Underlying Carrier&#8217;s network, it is essential that our Underlying Carrier engages in reasonable network management practices to benefit all users of the network.\u00a0 Legitimate network management purposes typically include reasonable security practices by providing: confidentiality, integrity and availability of network services, reasonable measures to address traffic that is harmful to the network and providing services or capabilities consistent with customer&#8217;s choices regarding services offered.<\/p>\n<p>When congestion occurs, you may experience reduced throughput or speed compared to non-congested times or to other users.\u00a0 Our Underlying Carrier may independently prioritize service for certain of its subscribers which may result in your network speeds being reduced during times of network traffic congestion as determined by our Underlying Carrier. Our Underlying Carrier may also use network management techniques to ensure the best possible experience for the most possible customers, including modifying the manner in which streaming video is delivered.\u00a0 It also may prioritize emergency communications, including by law enforcement, public safety officials, or national security authorities, consistent with or as permitted by applicable law, which may impact other users of its network, including our customers.<\/p>\n<p>The T-Mobile network is engineered for consistent high-speed service, but congestion may occur when customer demand exceeds available resources, resulting in reduced data speeds.<\/p>\n<p><strong>No Throttling or Blocking by Mission Telecom:<\/strong>\u00a0Mission Telecom does not engage in practices that block, throttle, degrade, or impair access to lawful content, applications, or services. Any instances of blocking, throttling, or application-specific behavior are controlled by the Provider and described in the T-Mobile Disclosures.<\/p>\n<p><strong>Other Network Prioritization<\/strong><\/p>\n<ul>\n<li><strong>Public Safety and Critical Infrastructure:<\/strong>\u00a0The network addresses priority needs of emergency communications, law enforcement, public safety, critical infrastructure, or national security authorities. T-Mobile provides certain services, such as Wireless Priority Service, that may preempt other traffic during extreme congestion, potentially interrupting an active data or voice session.<\/li>\n<li><strong>Affiliate Prioritization:<\/strong>\u00a0Other services that use the same network infrastructure (e.g., Voice over Internet Protocol (VOIP), Voice over new radio (VoNR), Voice over LTE (VoLTE), Video over LTE (ViLTE), and data priority for services with 5G network slicing) are given priority over general broadband internet access services. Mission Telecom does not engage in affiliated prioritization.<\/li>\n<\/ul>\n<p><strong>Paid Prioritization:<\/strong>\u00a0Mission Telecom does not engage in any practice that favors some traffic over other traffic in exchange for consideration, monetary or otherwise.<\/p>\n<p><strong>Does Mission Telecom limit data usage or provide customers with tools to monitor and control their data usage?<\/strong><\/p>\n<p>Mission Telecom offers service plans with pre-established allotments of data at designated speeds per month and the opportunity to purchase additional data.\u00a0 Certain uses of the Broadband Services may not count against a customer&#8217;s data allotment, check your specific service plan for details.\u00a0 If you use the Broadband Services in a manner that violates our Terms and Conditions, including our Acceptable Use Policy, available at <a href=\"https:\/\/missiontelecom.org\/es\/legal\/\" target=\"_blank\" rel=\"noopener\">https:\/\/missiontelecom.org\/legal<\/a>, we may suspend, terminate, or restrict your data session, switch you to a more appropriate data plan, or terminate your service.\u00a0 Customers may determine their remaining data balance by contacting customer service via one of the methods below.<\/p>\n<p>Mission Telecom may offer its customers with the ability to control and implement technology protection measures to manage access to the Internet, including filtering and blocking mechanisms (the &#8220;Filters&#8221;). For Customers with access to self-service account management tools, Customer shall be solely responsible for the operation, management, and maintenance of Filters and, the enforcement and application of Filters. For all other Customers, Customer is solely responsible for communicating to Mission Telecom the appropriate application of Filters and establishing expectations for access to the Internet and Internet-based content. Mission Telecom is not responsible for any usage or access to the Internet by Customer, or Customer&#8217;s users.<\/p>\n<p><strong>Does Mission Telecom block or reduce speeds for lawful Internet traffic based on content, application, service, or use of non-harmful devices or modify particular protocols?<\/strong><\/p>\n<p>Mission Telecom does not block or reduce speeds for (including impair or degrade) lawful Internet traffic on the basis of content, application, content provider, or use of non-harmful devices on its Broadband Services, subject to reasonable network management.\u00a0 Nor do we modify particular protocols, protocol ports, or protocol fields in ways not prescribed by the protocol standards.<\/p>\n<p>Our Underlying Carrier optimizes streaming video to deliver video in SD-quality video experience (typically 480p up to 1.5 Mbps), which is lower than HD or Ultra HD resolutions.\u00a0 In addition, your plan may be subject to data caps and may include reduced speeds; please check your service plan for details.\u00a0\u00a0 As outlined in the Acceptable Use Policy in our Terms and Conditions, we or our Underlying Carrier may need to block or limit the flow of traffic from certain locations or take other appropriate actions in response to a specific security threat against the networks of our Underlying Carrier or our customers.<\/p>\n<p><strong>Does Mission Telecom directly or indirectly favor some traffic over other traffic in its provision of the Broadband Services either in exchange for consideration from a third party or to benefit an affiliate?<\/strong><\/p>\n<p>No, Mission Telecom does not directly or indirectly favor some traffic over other traffic (such as through prioritization, resource reservation, or traffic shaping) in its provision of the Broadband Services for any type of consideration from a third party or to benefit an affiliate.\u00a0 During natural disasters and other emergencies, our Underlying Carrier may prioritize emergency communications, including those of law enforcement, public safety officials, or national security authorities, consistent with or as permitted by applicable law.<\/p>\n<p><strong>Performance Characteristics<\/strong><\/p>\n<p>Mission Telecom offers mobile broadband Internet access service using its Underlying Carrier&#8217;s networks.\u00a0 Performance of broadband Internet access services is generally evaluated based on speed and latency.\u00a0 Because, as described above, our reasonable network management practices and a variety of other factors can affect the performance of our Broadband Services, neither we nor our Underlying Carrier guarantee specific performance when you use our Broadband Services.\u00a0\u00a0 Additionally, the specific terms of your service plan may limit the amount of high-speed data included with your service plan and the actual speeds associated with data allocations included in your service plan.\u00a0\u00a0 Reduced network speeds may increase the latency you experience.<\/p>\n<p><strong>Note on Factors Affecting Performance:<\/strong>\u00a0 Although our Underlying Carrier engineers and manages its network to provide optimal performance to all users and user types, including based on average and anticipated peak usage of the network, the end-to-end performance of our Broadband Services can depend on a variety of factors, many of which cannot be anticipated or are outside of our and our Underlying Carrier&#8217;s control, including: your location relative to our coverage area, your proximity to a cell site, the capacity of the cell site, the number of other customers connected to the same cell site, the number of customers simultaneously using the network, the services other users are using, topography, weather, obstructions, use inside a building or a moving vehicle, radio frequency interference, the capabilities of your device, whether Mobile Hotspot (tethering) is being used, the applications you are using, the server with which your device is communicating, the source or destination of your Internet traffic, overall traffic on the Internet, whether there are network outages, and applicable network management practices discussed above.\u00a0 These factors can impact the availability of network resources for Broadband Services at any time.<\/p>\n<p>Mission Telecom expects customers with recent broadband-capable devices to generally expect the typical speeds and latency ranges described below, based on T-Mobile&#8217;s published network management policy disclosures.<\/p>\n<p>Actual availability, speed, and coverage may vary. The use of third-party equipment may not be permitted without prior written approval. Customers and Users require a capable device and SIM within an appropriate coverage area to access 4G LTE and 5G networks.<\/p>\n<p><strong>Security Measures<\/strong><\/p>\n<p>Mission Telecom takes network security seriously and refers customers to our T&amp;Cs, Privacy Policy, and AUP for a list of precautions we may take.
